The process of mediation can resolve these matters before they reach the point of no return.
Mediation is a private, voluntary procedure in which the parties discuss and attempt to resolve their dispute with the assistance of a neutral third person.
Most mediations achieve an agreement which is satisfactory to all parties and legally binding - saving time, money and sanity along the way.
Mediator / Attorney, Christopher Capoccia, has been privileged to mediate a wide range of personal and business disputes to peaceful resolutions.

THE MEDIATION PROCESS
1) Pre-mediation Conference: Before a proposed mediation, Chris (mediator) will confer with the parties to -
a. Determine the suitability of the matter for mediation.
b. Explain the mediation process and fee.
c. Schedule the mediation (in person or remote) at the convenience of the parties.
d. Collect the mediation deposit.
2) Mediation Opening Remarks: Chris will review the mediation process and the Mediation Agreement to be signed by the parties.
3) Nature of Dispute: The complaining party will first state the problem from their perspective - followed by the response from the other party. Each party will have sufficient time, without interruption, to state their position on the matter.
4) Information Sharing: Chris will assist the parties in a joint discussion of all relevant facts and issues pertaining to the dispute. Chris may confer with each party privately to better understand the nature of the dispute from their perspective.
5) Generate Options / Negotiate: Chris will facilitate the joint discussion of possible solutions to the problem, and then help the parties negotiate the best possible remedy.
6) Agreement / Closure: Upon successful mediation, Chris will assist the parties in writing a legally enforceable Mediation Settlement Agreement, and in preparing any necessary court documentation.
